Welcome to BORESHABiZ®️ software! These Terms and Conditions (“Terms”) govern your access to and use of our software and services. By using BORESHABiZ®️, you agree to comply with these Terms. Please read them carefully to understand your rights and responsibilities.

1. Acceptance of Terms

By downloading, installing, or using BORESHABiZ®️, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. User Account

2.1 Registration

To access certain features of BORESHABiZ®️, you may be required to create a user account. When registering, you agree to:

– Provide accurate, current, and complete information requested about yourself.

– Maintain the confidentiality of your account, password and other credentials.

– Update your account information to keep it accurate and complete.

2.2 Account Responsibility

You are responsible for all activities that occur under your account. If you suspect any unauthorized use of your account, you must notify us immediately at info@haveagobusinesssystems.com.

3. Use of the Software

3.1 License Grant

We grant you a non-exclusive, non-transferable, limited license to download, install, and use BORESHABiZ®️ for your personal or internal business purposes, subject to these Terms.

3.2 Prohibited Uses

You agree not to:

– Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from BORESHABiZ®️.

– Use the software for any illegal or unauthorized purpose.

– Attempt to gain unauthorized access to the software, other user accounts, or computer systems connected to BORESHABiZ®️.

– Use BORESHABiZ®️ to transmit any viruses, worms, or malicious content.

4. Content and Data

4.1 User-Generated Content

Any content you create, upload, or share using BORESHABiZ®️ remains your property. However, by using the BORESHABiZ®️, you grant us a worldwide, royalty-free, non-exclusive license to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations, or other changes we make so that your content works better with our services), communicate, publish, publicly perform, publicly display, and distribute such content.

4.2 Data Collection and Privacy

We may collect data about how you use BORESHABiZ®️ to improve our services. This may include information about your device, software usage, and interactions with the software. All data collection and use are governed by our BORESHABiZ®️ PRIVACY POLICY.

4.3 Deleting User Data

The Instructions for deleting your User Data are:

Go to the BORESHABiZ®️ app Settings Page
Scroll down and Press “Delete Account”
A prompt will appear asking if you are sure you want to delete the account; To delete press “Proceed”, or to cancel press “Cancel“

5. Intellectual Property

All intellectual property rights in BORESHABiZ®️ and its content, including but not limited to software code, graphics, trademarks, and logos, are owned by HAVE A GO BUSINESS SYSTEMS LIMITED or its licensors. You agree not to use these materials without our prior written consent.

6. Termination

6.1 Termination by You

You may terminate these Terms by discontinuing use of the software and deleting all copies from your devices.

6.2 Termination by Us

We reserve the right to suspend or terminate your access to BORESHABiZ®️ at our discretion, without notice, if we believe you have violated these Terms or engaged in illegal activities.

6.3 Effect of Termination

Upon termination, your right to use BORESHABiZ®️ will immediately cease. Any provisions of these Terms that by their nature should survive termination will remain in effect, including, but not limited to, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Updates and Changes

7.1 Software Updates

We may release updates, patches, or new versions of BORESHABiZ®️ to improve its functionality or fix issues. These updates may be automatically installed on your device.

7.2 Changes to Terms

We may modify these Terms at any time. If we make significant changes, we will notify you via email or through a notice on our website. Your continued use of BORESHABiZ®️ after any such changes constitutes your acceptance of the new Terms.

8. Disclaimers and Limitation of Liability

8.1 Disclaimer of Warranties

BORESHABiZ®️ is provided “as is” and “as available” without any warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the software will meet your requirements, be error-free, or operate without interruption.

8.2 Limitation of Liability

To the maximum extent permitted by law, HAVE A GO BUSINESS SYSTEMS LIMITED and its affiliates will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use or inability to use BORESHABiZ®️, even if we have been advised of the possibility of such damages. This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory.

9. Indemnification

You agree to indemnify and hold harmless HAVE A GO BUSINESS SYSTEMS LIMITED, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from or related to your use of BORESHABiZ®️, your violation of these Terms, or your infringement of any third-party rights.

10. Governing Law

These Terms and your use of BORESHABiZ®️ will be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Kenya for the resolution of any disputes.

11. Entire Agreement

These Terms constitute the entire agreement between you and HAVE A GO BUSINESS SYSTEMS LIMITED regarding your use of BORESHABiZ®️, superseding any prior agreements between you and HAVE A GO BUSINESS SYSTEMS LIMITED related to the software.
